The SS Code is limited to the Aviation Industry, including:

• Civil Aviation;
• Scheduled and non-scheduled airline operations, including passenger, freight, and general aviation;
• Aircraft maintenance, including engine and component overhauls and spare parts;
• Airline service providers;
• Ramp handlers;
• Airside operators;
• Airport facilities and services such as ACSA, Handling agents etc; and
• Navigation and technical service providers.

The empowerment requirements for non South African domiciled airlines differ to those for aviation in general and are captures in the foreign owned airlines B-BBEE scorecard.

Government undertakes to review the current policy of limiting foreign ownership in SA domiciled airlines in order to facilitate increased investment and job creation in the industry.

Government will develop a framework that will provide that State Owned Enterprises (SOEs) bind foreign suppliers of technology intensive products to B-BBEE obligations, for example, ownership, skills development, and enterprise development.

The black ownership target set is aimed at the SA domiciled airlines and Airline Service Providers.

Foreign owned entities and airlines are not required to sell equity to locals and thus, they will formulate and participate in an Equity Equivalent Programme using a 1.5% target of payroll of SA based staff.

Foreign owned airlines are excluded from complying with the Management Control element as the nature of their business precludes them from having local boards and top management structures.

Foreign owned airlines will be measure against the other occupational categories excluding top and senior management.

Government will commit to using its procurement policies to stimulate the development and support of new B-BBEE enterprises within the sector.

Foreign owned airlines undertake to capacitate and develop QSEs and EMEs by providing training in basic business skills and life skills determined at 1% of total payroll of SA based employees.

The following types of contributions allow for enhanced recognition of 1.25:

• HIV/AIDS Programmes;
• Education; and
• Community development and poverty alleviation.

Foreign owned airlines should invest at least 0.5% of payroll or the equivalent % of management’s time to SED initiatives which include HIV/AIDS treatment and prevention, education, community development, Aviation or Tourism General Awareness Campaign. The enhanced recognition factor above also applies.
