Introduction
Scope of application:
The scope extends to the entire rail industry, including state-owned operators and infrastructure companies.
These organisations need to drive transformation the rail industry value chain, including manufacturers, suppliers, consultants and maintenance companies via their purchasing power.

Ownership
It is important to note that the majority of the industry’s assets are publicly owned, thus, the challenge is to identify opportunities in the private sector whilst using the purchasing power of the rail parastatals to fast track the creation of black owned organisations within the sector.
NOTE: if the ownership by black people with disabilities is held through a NPO or Public Benefit Organisation, the organisation must prove that at least 85% of the beneficiaries are black disabled people in order to achieve the maximum available points.

The Preferential Procurement Scorecard
A key focus area is to identify areas where there is little procurement from black owned suppliers and develop strategies to rectify this.
The stakeholders commit to ensuring that organisations develop policies on Accounting for Affirmative Procurement and adopt the guidelines set by the Transport Sector BEE Council.
This will ensure that companies will possibly increase the amount of discretionary spending and will require companies to state, in their annual BEE Reports, the reasons for classifying an item as “non-discretionary”.
Companies should, as far as possible, use local suppliers opposed to foreign suppliers, and organisations should include early payment cycles, securities, and guarantees when procuring from black owned enterprises, QSEs and EMEs.
